Why Adidas' Philippine Flag jacket design was banned

REPUBLIC ACT NO. 8491

SECTION 34. It shall be prohibited:
a) To mutilate, deface, defile, trample on or cast contempt or commit any act or omission casting dishonor or ridicule upon the flag or over its surface;

b) To dip the flag to any person or object by way of compliment or salute;

c) To use the flag:
  1. As a drapery, festoon, tablecloth;
  2. As covering for ceilings, walls, statues or other objects;
  3. As a pennant in the hood, side, back and top of motor vehicles;
  4. As a staff or whip;
  5. For unveiling monuments or statues; and
  6. As trademarks, or for industrial, commercial or agricultural labels or designs.

d) To display the flag:
  1. Under any painting or picture;
  2. Horizontally face-up. It shall always be hoisted aloft and be allowed to fall freely;
  3. Below any platform; or
  4. In discotheques, cockpits, night and day clubs, casinos, gambling joints and places of vice or where frivolity prevails.
e) To wear the flag in whole or in part as a costume or uniform;
f) To add any word, figure, mark, picture, design, drawings, advertisement, or imprint of any nature on the flag;
g) To print, paint or attach representation of the flag on handkerchiefs, napkins, cushions, and other articles of merchandise;
h) To display in public any foreign flag, except in embassies and other diplomatic establishments, and in offices of international organizations;
i) To use, display or be part of any advertisement or infomercial; and
j) To display the flag in front of buildings or offices occupied by aliens.

I always interpreted E as: You can't cut a flag into pieces and put some or all of them on a costume or wear it in whole (like a bath towel).

I didn't notice and G though. Does that include "Pinoy Pride", Proud to be Pinoy" shirts, athlete wear and the like?

For "wearing the flag in part" I think would include shirts that have the 3 stars and sun design (but only if the stars and the sun are of course the same as the flag... I think that alterations on the design would get you off the hook).

Then as for G - "Proud to be Pinoy" prints on shirts aren't really representations of a flag. Those are simply "statement shirts".

Makes sense. Kind of fuzzy though since such 'alterations' can be then be copyrighted...a little short of trademarking.

For G, yeah, there are "statement shirts" and there are also those that include the flag. Just searching for "Philippine flag bandana" on ebay will yield a lot of results (and I think I've seen boxers in discount stores, too). INAL, but I think that can both be E and G at the same time.

This Republic Act is really fuzzy...

Yeah I remember this law (or whatever)... nagkamali nga kami nung concert ni Leehom kasi nagdala kami ng flag... XD after nun narealize ko mali ginawa namin...

may nakita ako noon na banner.. government release pa nga ata un.. may text above the flag... tsktsktsk di rin ata nila alam ung tungkol dyan e

i think this is the tym to revise our law regarding this r.a. 8491... ang pagsusuot ng jacket na may design na katulad ng flag natin e nagpapatunay na tayo ay proud to be pinoy

Ok i am in an Miss International Asia Pageant and i am representing the Philippines. Im now worried because i designed a gown as an "Ethnic Costume" to represent my Heritage/background. The dress is red, blue and white. I arranged the 3 stars and sun so as not to be an exact replica of the flag but i do not want to offend anyone, disrepect the flag, or get in legal trouble. I am from the USA. Does this law only apply in the philippines? or could i get into a lawsuit?

If the pageant is in the US then you will not be expected to follow Philippine laws - actually, you're not subject to them.

If you're in the US, you are only subject to the US laws. And since there is no US law pertaining to clothes patterned against foreign flags then you don't have to worry about anything.

this is just so sad. Told my sis to buy me the jacket 'coz am just proud to wear it here in Ireland, and she can't buy them anymore 'coz of this law. The law should change. It's about time to show the world we are proud to be pinoys.

Imitations of Adidas jacket are still available in Greenhills and there's a similar Philippine jacket being sold in Kultura (SM malls have that store).
